Terms of Service — Timistories

These Terms of Service (“Terms”) govern your use of the Timistories mobile application, the website at timistories.com, and all related services (together, the “Service”). By creating an account you accept these Terms. If you disagree with any of them, do not use the Service.

We have written these Terms in plain language. When a phrase has a precise legal meaning (“User Content”, “Credits”, “Pro Plan”), it is defined the first time it is used.

1. About the Service

The Service is operated by:

In these Terms, “Timistories”, “we”, “our” mean ILAD DIGITAL AGENCY - FZCO. “You” means the parent or legal guardian who creates the account.

The Service generates personalised stories (text, audio, illustrations) for your child to read or listen to, based on prompts you provide. Stories are produced by AI models (Google Gemini for text and illustrations, OpenAI text-to-speech for voice narration; Anthropic Claude is a configured fallback that is not active at v1); see the Privacy Policy for the complete list of sub-processors.

2. Eligibility

To create an account and use the Service you must:

Be at least 18 years old.
Be the parent or legal guardian of every child whose profile you create.
Have legal capacity to enter into a contract in your country of residence.

The Service is intended for family use and must not be used directly by a child. No account may be created by a minor.

3. Account

3.1 Creation

You create an account with a valid email address and a password. Email verification is required before your first story generation or first purchase.

3.2 Security

You are responsible for the confidentiality of your password and for all activity carried out from your account. If you suspect unauthorised access, write to support@timistories.com immediately; we can revoke all active sessions on your request.

3.3 Deletion

You can delete your account at any time from Settings → Account → Delete my account. A 30-day cooling-off period opens, after which your data is deleted as described in the Privacy Policy (section 10).

4. Intellectual property

4.1 What you create stays yours

The inputs you provide — story prompts, first names, family values, characters you describe, places you create, voice samples — remain your property. You grant us a limited licence to use these inputs solely to operate the Service (generate the story you asked for, store it on your account, deliver it to you).

4.2 Generated stories

The stories generated (text, audio, illustrations) from your prompts are your User Content, provided they do not infringe any third-party rights. You may:

Read them to your child.
Save them outside the application.
Share them with a small family circle through the shared-link feature we provide.

You may not:

Resell or commercially exploit them.
Republish them on a public platform (open social network, marketplace) as a standalone product.
Remove the “Generated with Timistories” attribution where it is included.

4.3 Licence back to us, to run the Service

You grant us a non-exclusive, worldwide, royalty-free licence to store, process, transmit and display your User Content for the sole purpose of (i) delivering the Service to you, and (ii) improving the Service (for example, anonymised analysis of failed generations to improve quality). This licence ends on permanent deletion of your account (see Privacy Policy section 10), except for data we must retain by law (e.g., accounting records).

4.4 Our intellectual property

The “Timistories” trademark, the logo, the “Crépuscule” design system, the application and its source code remain our property (or that of our licensors). Use of the Service does not transfer any of these rights to you.

4.5 Protected-terms catalogue

To prevent the generation of stories referencing third-party intellectual property (commercial universes, franchise characters), Timistories applies a server-side filter. If your prompt triggers this filter, the story will not be generated and you will be asked to rephrase. This filter is not exhaustive and does not relieve your responsibility under section 5 below.

5. Acceptable use

You agree not to use the Service to:

Generate content that infringes third-party intellectual-property rights (works, trademarks, related rights).
Generate sexual, gratuitously violent, hateful, harassing, defamatory, or unlawful content.
Generate content depicting an identifiable real person without their consent (including any child other than your own).
Attempt to bypass safety filters or generate stories aimed at audiences other than children aged roughly 3–9.
Reverse engineer, decompile, or attempt to extract the underlying AI models from the Service.
Overload the Service through massive automated requests.
Create multiple accounts to circumvent free-plan limits.

Any breach can lead to immediate suspension of your account. For serious breaches we reserve the right to terminate the account without refund.

6. Subscriptions and purchases

6.1 Plans

Free plan: 1 text-story generation per day, 1 child profile, 1 place, text reading. Audio narration costs Credits (see 6.4).
Pro plan (Timistories+): unlimited text generation, character and place library, a choice of narration voices, series and episodes, illustrated audio player. The Pro plan includes a quota of 10 audio credits per month (pro_monthly) or 120 per year (pro_yearly).

6.2 Payment methods

On iOS: in-app purchase via the Apple App Store (StoreKit). Apple’s terms apply in addition to ours.
On Android: in-app purchase via Google Play Billing.
On the web (admin only at v1): Stripe.

All purchases are validated through RevenueCat (our receipt-validation provider) or Stripe. The source of truth for your subscription status and credit balance remains our server.

6.3 Auto-renewing subscriptions

Read carefully — Apple §3.1.1 and Google Play requirement.

Pro subscriptions (monthly and yearly) are auto-renewing subscriptions.
Payment is charged to your App Store, Google Play or Stripe account 24 hours before the end of the current period.
Renewal is at the same price and for the same duration as the current period, unless a change is announced at least 30 days in advance.
To cancel renewal:
- iOS: iPhone Settings → [your name] → Subscriptions → Timistories → Cancel. Cancellation takes effect at the end of the current period.
- Android: Google Play → Profile → Payments and subscriptions → Subscriptions → Timistories → Cancel.
- Web (Stripe): Settings → Subscription → Manage (link to the Stripe Customer Portal).
No cancellation entitles you to a pro-rata refund for the period already started, unless the law of your country expressly grants you that right.

6.4 Credits

Credits are an internal Service unit used to:

Buy audio narration of a story (2 credits per render).
Unlock certain special fictional characters (common → legendary, variable price).
Unlock certain optional features.

Credits are granted:

At signup: 3 credits.
On the Free plan: 1 credit refilled daily.
On the Pro plan: 10 credits/month included (monthly) or 120/year (yearly).
Through credit-pack purchases (consumable, non-recurring).

Non-monetary nature: Credits are not currency, have no monetary value outside the Service, are not refundable in cash, are not transferable between accounts, and expire on account deletion.

Cache: if you request audio narration of the same story with the same voice and the same provider twice, the second time is free (caching saves us a vendor cost and we pass the savings on to you).

6.5 Gift codes and promotions

We may distribute gift codes or promotional vouchers as part of marketing operations. Such codes are not in-app purchases and cannot be bought individually; they are not refundable and expire on the date printed on the code (otherwise, within 12 months).

7. Refunds and right of withdrawal

7.1 iOS / Android purchases

For any purchase made through the Apple App Store or Google Play, the platform’s refund policy applies:

Apple: request via reportaproblem.apple.com within 90 days of purchase. The decision belongs to Apple.
Google Play: request via the Google Play help centre, generally within 48 hours of purchase.

We have no technical ability to issue a direct refund on these purchases — the transaction belongs to Apple or Google.

7.2 Stripe purchases (web)

For any Stripe purchase, write to support@timistories.com; we review each request on a case-by-case basis.

7.3 EU right of withdrawal — “digital content” exception

Pursuant to Article 16(m) of EU Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to digital content delivered immediately with your express consent. By tapping “Buy” in the application after seeing this notice you acknowledge:

Expressly requesting immediate performance of the Service.
Waiving your right of withdrawal for that specific purchase.

This waiver applies only to content already delivered. If you pay today for a yearly subscription and use 10% of the features in the first 14 days, you can request a pro-rata refund on the unused portion — write to support@timistories.com (subject, for iOS purchases, to Apple’s final decision).

7.4 Service unavailable / defective

If the Service has a major technical defect that prevents the use for which it was purchased for more than 7 days, you may request a full or partial refund by emailing support@timistories.com.

8. Copyright infringement notice (DMCA)

If you believe content available through Timistories infringes your intellectual-property rights, send a notification to copyright@timistories.com including:

Your full contact details (name, address, email, phone).
A description of the protected work concerned.
Precise location of the disputed content within the Service (URL or internal identifier).
A statement under penalty of perjury that you act in good faith and that you are the rights holder (or their representative).
Your physical or electronic signature.

We acknowledge receipt within 24 business hours and proceed with takedown within 10 business days at most if the notification is valid. A counter-notification procedure is available to the original poster; see our dedicated page at https://timistories.com/copyright (under construction; in the meantime, write to copyright@timistories.com).

Our repeat-infringer policy provides for account suspension on the third valid report.

9. Limitation of liability

To the extent permitted by applicable law:

The Service is provided “as is”. We do not guarantee that it will be uninterrupted, error-free, or that generated stories will be factually accurate (AI models may produce inaccurate or inappropriate content despite our filters).
Our total liability to you, all causes combined, is capped at the amount you paid us during the 12 months preceding the triggering event; in the absence of any payment, at €50.
We are not liable for indirect damages, loss of data, loss of opportunity, reputational harm.
Nothing in this section limits your liability or ours for damages that applicable law does not allow to be capped (notably wilful misconduct, fraud, harm to life or physical integrity).

10. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, damage or expense (including reasonable defence costs) arising from:

Your breach of these Terms.
Your use of the Service in violation of third-party rights (notably copyright, image rights, privacy rights).
Any User Content you provide.

We reserve the right, at our expense, to assume the exclusive defence of any matter for which you owe us indemnification, and you agree to cooperate reasonably.

11. Governing law and dispute resolution

11.1 Governing law

These Terms are governed by the laws of the United Arab Emirates (the jurisdiction of our registered office), excluding conflict-of-law rules.

11.2 EU consumer protection

If you are a consumer resident in the European Union, Regulation (EC) No 593/2008 (“Rome I”) guarantees you the benefit of the mandatory provisions of the law of your country of residence (notably consumer protection, the right to a local court, the legal warranty of conformity). The choice of UAE law above does not deprive you of these protections.

11.3 Amicable resolution

Before any litigation, we invite you to write to legal@timistories.com; we commit to reviewing every claim within 30 days.

11.4 Arbitration and courts

Failing amicable resolution, disputes will be submitted to arbitration under the rules of the Dubai International Arbitration Centre (DIAC), seat in Dubai, English language, unless a mandatory rule grants you another forum.
If you are a consumer resident in the EU, you may also bring the dispute before the courts of your country of residence or use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

12. Changes to the Terms

We may amend these Terms at any time. For substantial changes we will inform you by email and/or via an in-app notification at least 30 days before they take effect. If you continue to use the Service after that date, you are deemed to have accepted the new version. If you refuse, you may delete your account.

13. Severability, entire agreement, assignment

If a provision is held invalid by a court, the remaining provisions remain in force.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Timistories.
You may not assign your rights without our written consent. We may assign the contract as part of a merger, acquisition or asset sale.
